Health & Social Care Act - Section 11

 

 

 

Section 11 of the Health and Social Care Act 2001 places a duty on NHS trusts, Primary Care Trusts and Strategic Health Authorities to make arrangements to involve and consult patients and the public in service planning and operation, and in the development of proposals for changes.

 

This is a statutory duty, which means consulting and involving:

 

  • Not just when a major change is proposed, but in ongoing service planning
  •  

  • Not just in the consideration of a proposal, but in the development of that proposal
  •  

  • In decisions about general service delivery, not just major changes

In addition, best practice guidance was launched in October 2004 entitled “Getting over the wall: How the NHS is improving the patient’s experience”.

 

This is an illustrative document providing examples of how the outputs from patient and public involvement activity have influenced service planning and development in the NHS to deliver improvements for patients
